Terms of Service

These terms are an agreement between you and Gurman Soni trading as WanderlyMe. By creating an account or using the site you agree to them, so please read them carefully.

1. About these terms

WanderlyMe ("WanderlyMe", "we", "us") is operated by Gurman Soni, sole trader, Sydney, Australia (ABN {{ABN}}). These Terms of Service, together with our Privacy Policy and Refund Policy, govern your access to and use of wanderlyme.com and related services (the "Service"). If you do not agree, please do not use the Service.

2. What WanderlyMe is — and is not

WanderlyMe provides travel planning information only. We generate suggested itineraries, places, restaurants, accommodation ideas, budget estimates and related content to help you plan.

WanderlyMe is not a travel agent, tour operator, airline, accommodation provider or booking provider. We do not sell, arrange or hold bookings, tickets, accommodation, transport, insurance or visas. Any booking you make is a contract between you and the relevant supplier, on that supplier's terms. Prices shown are estimates, not quotes or offers.

3. AI-generated content and your responsibility to verify

Itineraries and recommendations are generated by artificial intelligence, then checked against third-party data sources such as Google Places. Despite this, AI-generated content may contain errors, omissions or outdated information, and venues may change, close or alter their hours and prices without notice.

You must independently verify opening hours, prices, availability, visa and entry requirements, health advice and safety information with official sources before booking or travelling. Items marked "Unverified" or "Adjusted" in particular should be treated as suggestions to check, not facts. You are responsible for your own travel decisions.

4. Accounts

  • You must be at least 18 years old, or have a parent or guardian's consent, to create an account.
  • You must provide accurate information and keep your login details secure. You are responsible for activity under your account; tell us promptly at hello@wanderlyme.com if you suspect unauthorised use.
  • One account per person. You may not share, sell or transfer your account.
  • You can delete your account at any time by contacting us. We may suspend or close accounts that breach these terms.

5. Paid plans

Some features may be offered as paid itinerary plans purchased through WanderlyMe. Prices are shown in the currency indicated at checkout and include GST where applicable. Payments are processed by Stripe. Delivery times, cancellations and refunds for paid plans are set out in our Refund Policy, which forms part of these terms.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in breach of any applicable law;
  • scrape, crawl, copy or bulk-download content, or use automated means to access the Service beyond ordinary browsing and search-engine indexing;
  • attempt to reverse-engineer, probe or circumvent security or rate limits, or interfere with the Service's operation;
  • upload or share content that is unlawful, defamatory, infringing, hateful or harmful, or that contains malware;
  • impersonate any person or misrepresent your affiliation;
  • resell or commercially redistribute generated itineraries as your own product without our written consent;
  • use the Service to build a competing dataset or to train machine-learning models.

7. Intellectual property

The WanderlyMe name, logo, design, software, destination guides and other original content are owned by us or our licensors and are protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service and to use the itineraries generated for you for your own personal, non-commercial travel planning.

You keep ownership of the content you enter (trip inputs, comments, suggestions). You grant us a licence to store, process, display and share that content as needed to operate the Service — for example, to show a shared trip to the people you share it with. Third-party data (such as Google Places information and map data) remains the property of its providers and is subject to their terms.

8. Third-party services and links

The Service relies on third-party providers (AI models, Google Places, Mapbox, Stripe, email delivery) and may link to external websites. We are not responsible for the content, availability or practices of third parties. Your use of third-party services is subject to their own terms.

9. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL or any other law that cannot lawfully be excluded, restricted or modified.

10. Limitation of liability

Subject to clause 9 and to the extent permitted by law: (a) the Service and its content are provided on an "as is" and "as available" basis for planning purposes, and we do not guarantee that content is accurate, complete or current; (b) we are not liable for any loss or damage arising from your reliance on generated content, from bookings or purchases you make with third parties, or from travel disruptions, closures, price changes, visa refusals, injury, illness or events outside our reasonable control; (c) we are not liable for indirect or consequential loss, or loss of profit, data or opportunity; and (d) our total aggregate liability to you in connection with the Service in any 12-month period is limited to the greater of the amount you paid us in that period and AUD $100.

Where the law permits liability for breach of a non-excludable guarantee to be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

11. Changes to the Service and these terms

We may change, suspend or discontinue features at any time. We may update these terms; the "last updated" date will change and, for material changes, we will give reasonable notice in the app or by email. Continued use after changes take effect means you accept the updated terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the Service, in which case we will where practicable give you the opportunity to export your saved trips. Clauses that by their nature should survive (including 7, 9, 10 and 13) continue after termination.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them. If you are a consumer in another jurisdiction, this does not deprive you of mandatory protections under your local law.
